CSHA is pleased to announce its 2021 Virtual Fall Seminar. Plan to join us for this informative and educational event!
For this year’s Fall Seminar on Friday, November 19, the CSHA Board of Directors would like you to join us and your fellow members in a special location – an online world called “Virbela.” Without leaving your home or office you will be able to enjoy meeting and talking with friends, exploring different parts of the “world” as well as listening to 6.75 hours of CLE topics with the quality of presenters you expect at a CSHA event. And although you will be spending the day in a virtual world, a non-virtual lunch will be delivered to your location through DoorDash.

10:15 – 11:15 am | Whose Medical Practice is it Anyway? A Discussion of California’s Prohibition on the Corporate Practice of Medicine

This program will provide an overview of the corporate practice of medicine doctrine in California, models for addressing corporate practice of medicine concerns, recent legislative development and enforcement actions, and a discussion of ways to address challenges presented by the corporate practice of medicine.
11:15 am – Noon | No Surprises Act: Implementation for California Hospitals
Amanda L. Hayes-Kibreab, King & Spalding LLP
This session will focus on understanding the requirements of the No Surprises Act, including the implementing regulations. Two Interim Final Rules have been issued which contain patient notice and consent requirements, a methodology for determining the payment amount, a dispute resolution process for determining out-of-network payment rates, requirements for good faith estimates, and the associated patient-provider dispute resolution process, and external review for payers. We will cover the impact of these rules, preparing for implementation in January 2022, and how the federal rule compares to similar state laws.

1:15 – 2:15 pm | Post-Pandemic Telehealth: Challenges, Growing Pains, and Questions Ahead

The COVID-19 public health crisis has spurred dramatic growth in telehealth adoption and utilization. Telehealth has emerged as an increasingly essential component of U.S. healthcare. This transformative period has also clarified central challenges to the post-pandemic growth of telehealth, some of which require legal and regulatory attention. These include ambiguity about the future of COVID-19 Public Health Emergency waivers, uncertainty about compliance issues from privacy and data security, and constraints imposed by federal and state laws. This session will feature a discussion of these issues by a panel of attorneys tackling these topics in their daily work.

All lawyers are “aging” – some, perhaps, at a faster rate than others. But as we age and change, what can we do about the signs and impacts of aging? Participants in this session will learn about:
- Aging and the prevalence of cognitive impairments
- Signs and symptoms of dementia
- The Lawyer Assistance Program and other resources for balance and a healthy lifestyle
- Developing a lifelong self-care plan and wellness strategies

It’s been a busy year on the medical staff legal front. 2021 saw two California Supreme Court decisions and one appellate court decision that will have significant, lasting impacts on peer review and medical staff law. In this session, our panel of attorneys with deep knowledge about these cases – including counsel of record – will discuss their perspectives on how these decisions are expected to impact physicians, medical staffs, and the peer review process.

Members who have successfully registered for the seminar will receive two separate emails:
- An email from CSHA confirming your registration for the event, sent after you’ve registered. This email includes a link to the participant information page. The participant information page includes a link to download the software and access Virbela’s private campus for the Fall Seminar and Cocktail Party.
- IMPORTANT: The Fall Seminar Private Campus is not the same as the Virbela Open Campus application that can be downloaded from Virbela’s website. Please use the link provided in the invitation email to access the correct Campus.
- And an email reminder the day before the event.
You must download and use the Virbela software to attend CSHA’s Fall Seminar. We strongly encourage you to start your firm’s information security review process, if any, as soon as possible if that may be required to download or access the program as quickly as possible. CSHA is not able to troubleshoot technical issues for you. Please review the hardware and software requirements to download the platform here or contact your IT department.

Attending the Seminar
The Fall Seminar will take place in a Virtual Event Space called Virbela. Virbela is a virtual reality experience with a private campus, reserved only for Fall Seminar participants – full of fun avatars customized by each attendee. We know that this is a new experience, and it may take a little time for you to feel comfortable.
Please reach out to your company/firm’s IT department and provide the Firewall and Anti Virus white list linked here to ensure you have no issues downloading the software come time for the events.
Please follow the instructions below to access the event campus:
Step 1: Download Virbela. Use the “Accept Invitation” button to access the Virbela download page. The correct Virbela campus should start downloading automatically. If not, click “Download” for the operating system you are using.
Step 2: Register Your Account. Upon launching Virbela, it will prompt you to register an account and login credentials for the event. Please fill in all fields and agree to Virbela’s terms and conditions to complete your registration.
Step 3: Dress for Success. After you’ve successfully registered your account, you’ll be taken to your closet to dress and adjust the look of your avatar. Once you’ve decided on your look, you’ll click the green checkmark on the right to move into the welcome area of the event campus.
Step 4: Enter the Campus. Your avatar will move into the welcome area, and avatars operated by Virbela staff will be there during the event times to direct you and answer questions. You should be able to hear them through the speaker on your computer and speak to them through your microphone (be sure your speakers are on). Feel free to move around and explore the campus before entering the conference room and finding a chair to sit down.
Please take a few minutes to print out and review the quick start guide on navigating and interacting with your avatar. At any time during the event, you can also reach out to the Virbela staff at email@example.com.

Continuing Legal Education
The California Society for Healthcare Attorneys is a State Bar of California-approved MCLE provider. The Fall Seminar provides 6.75 hours of MCLE credit, including one hour of specialty credit relating to competency.
